Even in states like California, persons looking to stop pregnancies may be impacted by the ongoing assault on access to abortion. Today, tablets rather than surgery are used in more than half of all abortions, and pro-life groups are working to limit access to these drugs.

A highly conservative federal court judge in Texas named Matthew Kacsmaryk is currently hearing the case that poses the greatest threat to women’s access to abortion drugs. His decision should come soon. Mifepristone was given the go-ahead by the Food and Drug Administration in 2000 as a safe and efficient method of terminating early pregnancies when used in conjunction with misoprostol.

The Alliance Defending Freedom, a traditional Christian group, is the representative of the Association for Hippocratic Medicine. The critics contend that the FDA improperly employed an expedited procedure for mifepristone approval, which is only meant for novel medications that would help people with serious or life-threatening conditions. They have requested that Kacsmaryk rescind the drug’s approval and forbid US doctors from prescribing it.

It would be rare for a judge to revoke a drug’s prescription, particularly one that has been available for 23 years and has been shown to be both safe and effective. Compared to delivery and surgical abortions, medically induced abortions are far safer. Yet it’s no accident that Kacsmaryk is hearing the case. Due to the fact that he is the sole judge assigned to the Amarillo Division of the U.S. District Court for the Northern District of Texas, all cases filed there are assigned to him.

Former President Trump appointed Kacsmaryk, who previously served as the First Liberty Institute’s deputy general counsel. In a partisan 52-46 vote, the Senate approved Kacsmaryk’s nomination in 2019. Kacsmaryk was the go-to person for Texas when they intended to fight President Biden’s “Remain in Mexico” policy, which mandated that people seeking asylum in the U.S. remain in Mexico while their petitions were being reviewed, at the conclusion of the Trump era. In a lawsuit that is currently before the Supreme Court, he succeeded in stopping the Biden action.

Conservative groups presented Kacsmaryk with a challenge to a federal programme that permits federally subsidised clinics to provide contraceptives to anyone who requests them. In December 2022, he disregarded Supreme Court precedents that expressly safeguard adolescents’ basic right to access contraception in doing so.
